Skylark Hire – Terms & Conditions

1. Definitions

“Lessee” means the person or business who makes the booking, completes the identity check and enters into the hire agreement with Skylark Hire.


2. Hire Period

  • Standard hire period is 48 hours unless otherwise agreed in writing.
  • Saturday night hires must be returned by close of business Monday.
  • Late returns incur additional charges per item, per day.

If equipment is kept beyond the 48-hour hire period, additional daily hire fees will apply, calculated as a percentage of the original hire cost per day until the equipment is returned.


3. Responsibility for Equipment

The Lessee is fully responsible for the equipment from:

  • Time of collection, or
  • Time of delivery

until it is returned and accepted by Skylark Hire.

The Lessee agrees to:

  • Pay full market replacement cost for lost, stolen or unreturned equipment
  • Pay for repair of damage caused by misuse or negligence
  • Notify Skylark Hire within 48 hours of any loss, damage or malfunction

Unpaid losses or damages may be referred to a debt recovery agency.


4. Equipment Condition

  • Fair wear and tear is accepted.
  • Damage caused by misuse, neglect or improper use will be assessed by a repairer.
  • If equipment fails due to a pre-existing fault, Skylark Hire will provide a refund or credit for the affected item(s).

5. Access & Tracking

The Lessee agrees to provide reasonable access for inspection, repair or collection.
Skylark Hire may use tracking technology to assist in equipment recovery and security.


6. Public Liability & Insurance

The Lessee is solely responsible for ensuring appropriate Public Liability Insurance is held for the hire period.

Skylark Hire accepts no responsibility or liability for:

  • Personal injury
  • Property damage
  • Loss or claims arising from the use or misuse of the hired equipment

The Lessee agrees to indemnify and hold harmless Skylark Hire against any claims, losses, damages or legal actions arising from the use of the equipment.


7. Use of Equipment

The Lessee agrees to:

  • Use the equipment safely and correctly
  • Not modify, deface or remove identification labels
  • Not sub-hire, transfer or assign the equipment
  • Not take the equipment outside the hiring state without written consent

A $50 per item charge applies for damaged or removed labels.


8. Security Bond

A refundable security bond is required before equipment is released:

  • $200 minimum bond for PA systems, speakers, microphones and accessories
  • $400 minimum bond for Pioneer DJ equipment

The bond may be used to cover:

  • Damage
  • Loss
  • Late return fees
  • Cleaning or repair

Unreturned equipment after 7 days may be treated as lost and charged at full replacement value.


9. Charges & Payments

  • The Lessee remains responsible for all charges, even if invoiced to a third party.
  • Late payments may incur an accounting fee of 3.5% per week on the outstanding balance.
  • Discounted rates will revert to standard rates if qualifying hire periods are not met.

10. Faults & Servicing

If equipment fails due to fault:

  • Skylark Hire will repair, replace or credit the affected items.
  • After-hours or call-out service is not guaranteed and is charged separately.

11. Delivery & Collection

The Lessee is responsible for:

  • Safe and clear access to delivery and collection locations
  • Ensuring equipment is ready for pickup

Delays exceeding 15 minutes may incur a minimum charge of $80 per hour.


12. Right to Refuse Service

Skylark Hire reserves the right to refuse hire to any person or entity without explanation.


13. Copyright

The Lessee indemnifies Skylark Hire against any copyright claims arising from use of hired equipment.


14. Legal

These Terms & Conditions are governed by the laws of Queensland, Australia.
If any part of these terms is found invalid, the remainder remains enforceable.
